Definitions

The terms used in the Regulations shall mean:

Customer - a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who makes an Order from the Store;

Regulations - these Regulations for the provision of electronic services for the online store at aarkada.com;

Website - the Internet service available at www.aarkada.com, of which the Online Store is a part, through which the Customer may, in particular, place Orders;

Goods - products presented in the Online Store, which is part of the aarkada.com Service;

Sales contract - a contract of sale of Goods concluded between AArkada sp. z o. o. Walońska 9/2U Street 50-413 Wrocław, NIP: 8993029360, and the Customer, concluded using the Store's website;

Consumer Rights Act - the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827);

Electronic Services Act - the Act of July 18, 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);

Order - a declaration of will of the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.

  1. General provisions

1.1 These Regulations set out the rules for the use of the online store available at www.aarkada.com;

1.2 These Rules and Regulations are the rules and regulations referred to in Article 8 of the Law on Provision of Electronic Services.

1.3 The online store, operating under www. aarkada.com, is operated by AArkada sp. z o. o. Walońska 9/2U Street 50-413 Wrocław, NIP: 8993029360.

The store does business at the address:

1.4 These Regulations set forth in particular:

  1. (a) the rules for registering and using an account within the online store;
  2. (b) terms and conditions for making electronic reservations for products available through the online store;
  3. (c) the terms and conditions for placing electronic Orders within the online store;
  4. d) the principles of concluding Sales Agreements using the services provided by the Online Store.

1.5 Customers may access these Terms and Conditions at any time via the link provided on the website www.aarkada.com.

  1. Rules of use of the Online Store

2.1 In order to conclude a Sales Contract through the Online Store, you must enter the website www. aarkada.com, make a selection of products, taking subsequent technical actions based on the messages displayed to the Customer and the information available on the website.

2.2 The Customer's selection of ordered Goods is made by adding them to the shopping cart.

2.3 In the course of placing an Order - until pressing the "Order" button. - The Customer has the possibility to modify the entered data and in the selection of Goods. To do this, follow the messages displayed to the Customer and the information available on the site.

2.4 Registration on the site is not necessary to place an order in the Online Store.

2.5 After the Customer using the Online Store has provided all the necessary data, a summary of the submitted Order will be displayed. The summary of the submitted Order will include information regarding:

  1. (a) the subject matter of the contract,
  2. b) the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
  3. (c) the selected payment method,
  4. (d) the selected method of delivery,

2.5 In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the "Order" button.

2.6 The Customer's sending of the Order constitutes a statement of intent to conclude a Sales Contract with the Store operator, in accordance with the content of the Regulations.

2.7 After placing an Order, the Customer receives an e-mail entitled "Order Confirmation", which confirms the placement of the Order.

2.8 The Contract shall be deemed concluded upon receipt by the Customer of the e-mail message referred to above.

2.9 The sales contract shall be concluded in the Polish language, with the content in accordance with the Regulations.

2.10. The online store reserves the right to cancel the order if the customer does not pay for the goods within three working days.

III. User registration

3.1 The customer may register on the site by creating a user account - for this purpose, register an account on the website www.aarkada.com and accept the provisions of these Regulations.

3.2 Proper registration involves filling in all required fields of the registration form.

3.4 The processing of personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) is governed by the Privacy Policy located at: www. aarkada.com/policy-privacy.

3.5 Providing personal data during registration or placing an order is voluntary, although necessary for the execution of the sales contract, concluded by the customer of the aarkada.pl online store with the Seller. The customer has the right to access the content of his data and correct them, which can also be done in the user panel.

3.6 The customer may at any time and free of charge delete the user account and terminate the contract for the provision of services for the operation of the aarkada.com online store.

3.7 Any complaints regarding services provided electronically and related to the functioning of the aarkada.com online store, the Customer may submit to the email address [email protected]. A complaint submitted in this way will be considered by the Seller within 14 days from the date of its receipt by the Seller.

  1. Delivery

4.1 Delivery of the Goods shall be made to the address indicated by the Customer when placing the Order.

4.2 We make every effort to make the processing and shipment date of your order as fast as possible. The time limit for us to ship an order is 1 to 3 business days from the day the Customer pays for the Order. Almost all orders are shipped within 24 hours of the order being placed, only in exceptional cases their processing may be prolonged.

4.3 Delivery of ordered Goods is carried out by courier service or by personal collection. Delivery costs are precisely specified when placing an order and are visible under the list of selected products. The entire payment of the customer is the sum of the price of all ordered products and the cost of delivery.

4.4 The duration of delivery after collection by the carrier depends on the type of delivery method selected by the customer and is determined by the regulations of each carrier.

4.5 Recording, securing, making available and confirming to the Customer the material provisions of the Agreement for sale of Goods shall be done by sending to the Customer at the e-mail address provided and by attaching to the parcel containing the Goods a printout of the confirmation or specification of the Order or a receipt or a VAT invoice.

  1. Prices and payment methods

5.1 The prices of the Goods are given in Polish zloty and include all components, including VAT (with the distinction of the rate).

5.2 The customer has the option to pay the price:

  1. a) by wire transfer, to the bank account number:

  1. b) payment in the Przelewy24 system.
  2. d) on delivery, in the case of choosing a shipment on delivery .
  1. Withdrawal from the Sales Agreement

6.1 The customer has the right to withdraw from this contract within 14 days without giving any reason.

6.2 The period for withdrawal from the contract expires after 14 days from the day on which the Customer took possession of the item or on which a third party other than the carrier and indicated by the Customer took possession of the item.

6.3 In order to exercise the right of withdrawal, the Customer must inform the Store of his/her decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by e-mail to: [email protected]; or by regular mail to: AArkada sp. z o. o., 12A Dekoracyjna St. 65-155 Zielona Góra, telephone number: +48 790 400 740.

6.4 In order to comply with the deadline for withdrawal, it is sufficient that the dispatch of information concerning the exercise of the Customer's right of withdrawal is made before the expiry of the deadline for withdrawal.

6.5 Effects of withdrawal from the contract

  1. a) In the event of withdrawal from this contract, we will return to the Consumer all payments received from the Consumer, including the costs of delivering the item, immediately and in any case no later than 14 days from the date on which the Shop was informed of the Consumer's decision to exercise the right of withdrawal. The payment will be refunded using the same method used by the Consumer, unless the Consumer has expressly agreed to a different method of return that does not involve any costs for him. The Shop may withhold reimbursement until it has received the item or until it has provided proof of its return, whichever event occurs first.
  2. b) The Consumer is obliged to return the Goods to the Seller immediately, but no later than within 14 days from the date on which he withdrew from the Sales Contract. To meet the deadline it is sufficient to return the Goods to the Seller's address before the expiration of this period.
  3. c) The right of withdrawal from the Sales Agreement does not apply to the Customer who is a Consumer with respect to contracts in which the Goods is an item delivered in a sealed package, which cannot be returned after opening the package for health or hygienic reasons, if the package has been opened after delivery.
  4. d) If the Consumer exercising the right of withdrawal has chosen a method of delivery of the Goods other than the cheapest ordinary method of delivery offered by the Seller, the Seller shall not be obliged to reimburse the Consumer for the additional costs incurred by the Consumer.
  5. (e) In the event of withdrawal, the Customer who is a Consumer shall bear only the direct costs of returning the Goods.
  6. (f) The consumer shall be liable for any diminution in the value of the Goods resulting from the use of the Goods beyond what is necessary to ascertain the nature, characteristics and functioning of the Goods.
  7. (g) The address to which the Customer shall return the goods is:

VII. Complaints regarding the Goods

7.1 Aarkada sp. z o.o. as a seller is liable to the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular Article 556 and Article 556[1] - 556[3] of the Civil Code.

7.2 Complaints arising from violation of the Customer's rights guaranteed by law or under these Terms and Conditions should be sent by e-mail to [email protected], or by post to the following address: AArkada sp. z o. o., 12A Dekoracyjna St. 65-155 Zielona Góra, and by phone at +48 790 400 740. AArkada sp. z o. o. undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.

7.3 If it is necessary to return the product, the Customer should send the item to the address of the Store: AArkada sp. z o. o., 12A Dekoracyjna St. 65-155 Zielona Góra. The cost of shipment will be refunded to the customer if the complaint is accepted.

7.4 If a complaint results in the return of goods, the Store shall refund the customer the full amount paid for the goods and the cost of delivery.

7.5 In case AArkada sp. z o. o. is not the manufacturer of the goods. The manufacturer shall be liable under the warranty of the sold Goods under the conditions and for the period indicated in the warranty card. If the warranty document provides for such possibility, the Customer may submit his/her claims under the warranty directly to the authorized service center, the address of which is indicated in the warranty card.

VIII. Final Provisions

8.1 Settlement of potential disputes arising between Aarkada sp. z o.o. and the Customer, who is a consumer within the meaning of Article 22[1] of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

8.2 Settlement of any disputes arising between [online store operator] and a Customer who is not a consumer within the meaning of Article 22[1] of the Civil Code shall be submitted to the court having jurisdiction over the registered office of the online store operator.

8.3 In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on Providing Services by Electronic Means and other relevant provisions of Polish law shall apply.
